Advertiser Terms and Conditions  

1. Adultsneed operates an adult website.
2. Advertiser wishes to have Adultsneed provide Advertiser’s material on the website.
3. Advertiser warrants and undertakes to Adultsneed that the material provided by Advertiser is:-
   
1. The property of or Advertiser has the right to publish all and every item of the advertising material without limitation and in particular on the Adultsneed’s website.
   
2. The advertising material does not contain misleading or deceptive representations or breaches or is likely to cause any breach of any consumer protection provisions including but not limited to the Trade Practices Act 1974 and any consumer or Fair Trading laws or regulations in any State or Territory in Australia.
   
4. Advertiser indemnifies Adultsneed from all or any claim directly or indirectly against Adultsneed arising from the advertising material being published by Adultsneed in accordance with the Advertiser’s request on the Adultsneed website.
   
5. Advertiser acknowledges that Adultsneed may at any time if the advertising material breaches all or any laws or regulations for the use or publication of such material immediately withdraw such material from the Adultsneed website.
   
6. Adultsneed will immediately on any action as required and made by Adultsneed in accordance with Clause 3 give written notice to Advertiser.
7. Advertiser confirms that it is a principal and that Adultsneed is the agent of the Advertiser.
   
8. Advertiser confirms and undertakes to Adultsneed that the advertising material may be published by Adultsneed as agent of the Advertiser and that if appropriate the Advertiser is aware of laws governing prostitution and the advertising of prostitution services in each State and Territory of Australia and that the advertising material:-
   
1. Does not breach or is licensed for publication in all of the States and Territories of Australia and the Advertiser by requiring Adultsneed to publish the advertising material has not knowingly participating directly or indirectly in the provision of prostitution by any person or supplying prostitution services to any person.
   
2. Or is not likely to induce any person to seek employment as a prostitute or any business that provides or is connected with massage, prostitution and massage services.
   
9. Advertiser in the event of any action arising out of these terms and conditions or in any use of the advertising material and whether such action is directly or indirectly taken against Adultsneed indemnifies Adultsneed on a full indemnity basis for all direct, indirect and consequential loss and damage and liabilities including any legal costs suffered by Adultsneed as a result of or caused by or contributed to by:-
   
1. Adultsneed publishing on its website the advertising material.
   
2. Any false statement contained in Advertisers declaration of facts as above.
   
3. Any act or omission or default connected with any advertising material for the Advertiser.
   
10. Advertiser acknowledges that this indemnity is provided to Adultsneed personally and on behalf of any associated entity for the joint and several benefit of Adultsneed Pty Ltd.
    
11. Advertiser acknowledges that:-
    
1. Adultsneed may but is not bound to accept or undertake any changes to advertising material unless such change is required due to neglect, default or an error of Adultsneed.
   
2. Advertiser is not entitled to any refund of any unexpended portion of the advertising fee or monies paid or due to Adultsneed if Advertiser notifies Adultsneed that it wishes to withdraw the advertising material.
   
3. Alterations may be made – notwithstanding 9(1) at and for a price and on conditions agreed between Adultsneed and Advertiser.
